Hope is focused on the task force to eradicate online gambling in Indonesia

With the number of victims of online gambling continuing to increase, the Indonesian government has officially declared war on the practice.

Considering the negative impact of online gambling on society, the government has prepared a special weapon to eradicate it, namely Presidential Decree Number 21 of 2024 concerning the Online Gambling Eradication Task Force which was signed by President Joko Widodo on June 14.

An online gambling eradication task force has been formed based on this decision. The task force is intended to spearhead efforts to eliminate online gambling, from upstream to downstream.

The task force, led by the Coordinating Minister for Political, Legal and Security Affairs, Hadi Tjahjanto, consists of personnel from the Ministry of Communication and Information, Polri, TNI, Attorney General’s Office, Center for Financial Transaction Reports and Analysis (PPATK), and other institutions.

After the decree was signed, Tjahjanto and task force personnel held their first meeting on June 19 to discuss concrete steps to eradicate online gambling.

The formation of the task force is considered important because online gambling has become a serious problem that requires immediate resolution. From the unemployed to civil servants, many people are getting caught up in online gambling because of the lure of making money quickly.

According to data from the Coordinating Ministry for Political, Legal and Security Affairs, even children under 10 years old have been involved in online gambling.

Based on records, 2 percent, or 80,000 online gambling players, are under 10 years old. Additionally, those aged 10–20 years make up 11 percent, or around 440,000 of the total players.

In the 21–30 year age group, the number has reached 520,000 or 13 percent of the total. Meanwhile, in the 30 to 50 year age group the number reached 1.64 million people or 40 percent of the total.

Then, for people aged over 50 years, the number reached 1.350 million people or 34 percent of the total.

The Ministry noted that among the upper middle class, the average value of online gambling transactions ranges from IDR 100,000 (around US$6.07) to IDR 40 billion (around US$2.42 million), while among the lower middle class it is around that range. IDR 10,000 to IDR 100,000.

Therefore, the task force is currently trying to save people who are addicted to gambling. Apart from that, many online gamblers fall into the trap of online loans.

Online gambling is prohibited in Indonesia according to Article 27 Paragraph (2) of Law Number 1 of 2024 concerning the Second Amendment to the Information and Electronic Transactions (ITE) Law.

Based on Article 27 Paragraph (2), “any person who intentionally and without authorization disseminates, transmits, and/or makes accessible electronic information and/or electronic documents containing gambling content” is considered to be violating the rules.

In this article, what is meant by “distributing” is sending or distributing information or electronic documents to many people via an electronic system.

Meanwhile, what is meant by “transmitting” is sending electronic information and/or documents to other parties via an electronic system.

Furthermore, “making accessible” refers to all efforts, other than distributing and transmitting, that can enable others to access the information.

In other words, public figures or other parties who deliberately promote online gambling on social media can also be prosecuted legally.

Those who violate the rules will be subject to imprisonment for a maximum of 10 years and/or a fine of a maximum of IDR 10 billion (around US$607,288), as regulated in Article 45 Paragraph (3) of Law Number 1 of 2024.

Task force assignments

At the office of the Coordinating Ministry for Political, Legal and Security Affairs in Jakarta on June 19, Tjahjanto and gambling task force personnel outlined several major tasks that must be completed within one to two weeks.

One of its tasks is to eradicate online gambling by closing online game credit top-up services at minimarkets.

This is of concern to the task force because there are several online games that are affiliated with online gambling practices. Therefore, online gaming credit top-up services are considered to be one of the drivers of the rise of online gambling in society.

For this step, TNI non-commissioned officers (Babinsa) from villages and police security and public order (Bhabinkamtibnas) officers will be the main movers in the field. They will inspect minimarkets and ask them to close the service.

At the same time, the Task Force will also coordinate with minimarket companies regarding efforts to close these services.

So far, the task force has data on around 4,000–5,000 bank accounts that are actively carrying out online gambling transactions.

This data will be submitted to the Police Criminal Investigation Unit so that transactions carried out through the account can be investigated. The agency will then freeze the accounts and make it public.

If within 30 days no one admits ownership of the account, the institution will hand over the funds in the account to the state.

After that, the agency will investigate the account owner to identify the main operator of the online gambling site.

So far, the Task Force has identified a new mode that many people use to carry out gambling transactions, namely buying and selling bank accounts.

This practice is closely related to online gambling because trading accounts are used to store gambling winnings.

The method is that the perpetrator approaches people and asks them to open an online bank account with the promise of a reward. People are required to submit personal documents such as KTP and Family Card for this purpose.

The perpetrator then handed over the bank account to the party trading the account so that it could be used for online gambling transactions.

The task force has deployed Babinsa and Bhabinkamtibnas to detect bank account trading activity and disseminate information regarding the risks of online gambling.

Blocking

The public is now discussing the discourse of blocking several social media platforms. The blocking will be carried out by the Ministry of Communication and Information because several social media sites are suspected of contributing to the spread of online gambling and pornographic content.

One of the platforms that received a warning from the ministry was Telegram.

Minister of Communication and Information, Budi Arie Setiadi, stated that his ministry had sent the first and second warning letters to Telegram.

However, because they have not yet responded, the ministry will send a third warning letter as a final warning. If Telegram does not respond, the ministry will block the platform.

According to data released by the Ministry of Communication and Information as of January 2024, around 800,000 online gambling sites have been blocked by the government.

Meanwhile, in the period 17 July 2023 to 13 June 2024, the Ministry of Communication and Information has removed 2,945,150 content items related to online gambling.

Indeed, eradicating online gambling in the digital era requires commitment and hard work. However, the Ministry of Communication and Information is optimistic that the online gambling task force will be able to eradicate online gambling which has claimed many victims in the country.
